  • On 29 September 2023, despite ongoing challenges in a number of jurisdictions, FIFA confirmed that the FIFA Football Agent Regulations (the FFAR) would enter into force on 1 October 2023 as planned.

    However, given the ongoing challenge and injunction in Germany, FIFA has clarified that the FFAR will be suspended for all transactions with “a link to the German market”, and the German FA will not introduce any NFAR. All other national associations must provide an exemption for transactions with a link to Germany.

    In addition, as a result of the ongoing challenge in England, The FA has delayed the implementation of its NFAR until around 30 November 2023.

  • The Agents Chamber will hear disputes from 1 October 2023 provided that they relate to Representation Agreements with an “international dimension” that were entered into by a Football Agent and a player, coach or club on or after 1 October 2023.

  • A Representation Agreement is a “written agreement for the purpose of establishing a legal relationship to provide Football Agent Services”. The term “Football Agent Services” is defined very broadly to include any negotiation or other related activity where the intention or effect is to facilitate the employment, registration / deregistration or transfer of a player or the employment of a coach.

    Article 12.7 of the FFAR sets out the minimum terms which must be included within a Representation Agreement.

  • An international dimension exists when the Representation Agreement governs Football Agent Services which are related to:

    i) a specified transaction in connection with an international transfer (or a move of a coach to a club affiliated to a different member association than their previous employer or the move of a coach to another member association than their previous employer); or

    ii) more than one specified transaction, one of which is connected to an international transfer (or a move of a coach to a club affiliated to a different member association than their previous employer or the move of a coach to another member association than their previous employer).

  • No, the Agents Chamber will only be able to hear disputes regarding Representation Agreements entered into on or after 1 October 2023.

  • A Football Agent or their Client can always seek redress before an ordinary court of law.

    However, that would be unusual. More often, disputes involving Football Agents that do not have an “international dimension” will be decided by the relevant Association’s national dispute resolution bodies.

  • Parties who wish to bring a claim before the Agents Chamber must do so within two years of the event that gave rise to the dispute.

  • There will be no procedural cost to bring a claim before the Agents Chamber. However, parties must bear their own legal costs and will not be able to recover them from the other side.

  • Yes. Only a FIFA-licensed Football Agent is permitted to perform Football Agent Services and enter into Representation Agreements.
