The English Challenge – an update

Outcome of the English Challenge DELAYED

On 27 September 2023, The FA confirmed that the arbitration proceedings commenced by the agencies CAA Base, Wasserman, Stellar and ARETÉ had concluded.

Despite initially indicating that it would issue its award by 1 October 2023, the Tribunal in those proceedings has indicated that it will be delayed until around 30 November 2023. The FA has therefore agreed not to implement its National Football Agent Regulations until the earlier of (a) 30 November 2023 or (b) the handing-down of the Tribunal’s award.

Until that time, the current FA Working With Intermediaries Regulations will remain in force, meaning (for now) the FFAR / NFAR do not apply in England and a Football Agent Licence is not required for transactions in England - but the FFAR will be in force elsewhere in the world (subject to the positions in Germany and France).
